Hulk Hogan, one of America's best-known wrestling stars, has died at the age of 71. The star, born Terry Gene Bollea and known for his flowing blond hair and iconic handlebar moustache, died at his home in Florida on Thursday. Hogan began his professional wrestling career in 1977, but shot to fame after signing for the World Wrestling Federation (WWF), as it was known before it became World Wrestling Entertainment (WWE), in 1983. He was one of the most prominent characters as the popularity of wrestling exploded, and later became well-known for his reality show, Hogan Knows Best, which aired on VH1 from 2005 to 2007.

Hogan's manager Chris Volo said the wrestler suffered a cardiac arrest at his home in Clearwater, Florida, and died surrounded by his family. More recently, Hogan had been a vocal a supporter of US president Donald Trump. In a post on his social media site Truth Social, Trump wrote that he had"lost a great friend today", the"Hulkster"."Hulk Hogan was MAGA all the way — Strong, tough, smart, but with the biggest heart. He gave an absolutely electric speech at the Republican National Convention, that was one of the highlights of the entire week," Trump wrote in the post, referencing his slogan, Make America Great Again. The WWE star had neck surgery in May and heart surgery in June. In a post on Instagram, his family wrote that they had"lost a legend"."May we all take solace in the wonderful memories he left behind for the millions of fans worldwide whose lives he touched for more than four decades," they wrote."He will be missed, but never forgotten." Police officials said on Thursday that emergency services responded to a medical call at 10:00 EST (15:00 BST), where they found Hogan experiencing a serious medical issue. He was taken to a hospital where he died at 11:17. There will be an investigation, they said, but there is no suspicious activity surrounding his death.

In a statement, WWE said it was"saddened to learn WWE Hall of Famer Hulk Hogan has passed away"."One of pop culture's most recognisable figures, Hogan helped WWE achieve global recognition in the 1980s."WWE extends its condolences to Hogan's family, friends, and fans." Hogan's larger-than-life personality and talent in the ring helped make professional wrestling more accessible to the mainstream public. He won six WWE championships and headlined WrestleMania, WWE's signature event, eight times. He was inducted into the WWE Hall of Fame in 2005. Hogan's opponents included Dwayne 'The Rock' Johnson, 'Macho Man' Randy Savage and Andre The Giant. Wrestling legend Ric Flair said he was"absolutely shocked" to hear about Hogan's death."An incredible athlete, talent, friend and father," he said in a post on X."Our friendship has meant the world to me. He was always there for me even when I didn't ask for him to be." Fellow legend in the ring the Undertaker also paid tribute:"The wrestling world has lost a true legend. His contributions to our business are immeasurable and for that I am appreciative." Donald Trump Jr, the son of the US president, posted a selfie with Hogan from 2024, writing:"RIP to a legend." Mike Johnson, the Republican speaker of the House of Representatives, wrote on X:"We all have fond memories of Hulk Hogan. From my childhood in the '80s, to campaigning with him last year, I always saw him as a giant in stature and in life." Carlos Silva, president of wrestling brand Total Nonstop Action Wrestling, said:"Hogan's name was synonymous with professional wrestling, transcending the industry to become an American pop culture fixture."

Born in the US state of Georgia in 1953, Hogan was one of the most famous names in professional wrestling history. His"Hulk" nickname came from comparisons to the comic-book hero portrayed on TV at the time, while"Hogan" was the invention of promoter Vince McMahon, who was keen for Irish representation in the WWF. He first competed in the WWF in 1979, but became a mainstay and fan favourite in the mid-1980s alongside Andre the Giant and 'Rowdy' Roddy Piper. Hogan headlined the first WrestleMania in New York in 1985, where he and Mr T defeated Piper and Paul Orndorff. In the ring, Hogan's character was an all-American hero, and his magnetic personality helped attract millions of viewers and turn wrestling into a revenue juggernaut. His brand of"Hulkamania" transferred to the small and big screens, with roles in films such as Rocky III, No Holds Barred, Suburban Commando, Mr Nanny, Santa With Muscles, and a 1996 episode of Baywatch. Rocky actor Sylvester Stallone said on Instagram that Hogan was"absolutely wonderful and his amazing skill made Rocky III incredibly special". Hogan also appeared as himself in the A-Team, Gremlins 2: The New Batch, Spy Hard and Muppets From Space, and lent his voice to episodes of Robot Chicken and American Dad! In 1985, Hogan became the star of his own cartoon series on CBS, Hulk Hogan's Rock 'n' Wrestling.

Hogan was first inducted into the WWE Hall of Fame in 2005, but he was removed from the hall in 2015 when his WWE contract was terminated after a tape emerged of him using a racist slur. Three years earlier, gossip website Gawker posted a video of him having an affair. Hogan subsequently sued the website on privacy grounds, winning $140m (£103m) and forcing it out of business in 2016. In 2018, the company reinstated him, saying he deserved a second chance, but several WWE superstars, including the New Day and Titus O'Neil, said it would be"difficult to simply forget" what Hogan had said. In recent years, Hogan appeared at Trump rallies and on the US election campaign trail. He starred at the 2024 Republican National Convention, ripping off his shirt - a signature move - to reveal a Trump 2024 T-shirt.

As Donald Trump heads to Scotland, what to expect from his visit

Donald Trump flies into Scotland later to visit two golf resorts which he owns in the country where his mother was born. He will travel to Turnberry in South Ayrshire, a world class venue he bought in 2014, and to Menie in Aberdeenshire to open a new 18-hole course. The White House says Trump will also meet prime minister Sir Keir Starmer to discuss trade while he is in the UK. The trip is exceptional as US presidents rarely promote their personal interests so publicly while in office. It is not the first time that Trump has been accused of conflating his own affairs with the nation's. Even so, with Gaza and Ukraine in flames, the dollar on the slide, and questions mounting about his ties to convicted paedophile, Jeffrey Epstein, Trump's decision to focus on golf has raised eyebrows.

I witnessed Trump's unconventional attitude first hand, right at the start of his political career, when I met him on the campaign trail in 2015 as the Republicans searched for a candidate who could win back the presidency after Barack Obama's two terms in office. Trump strode off the debate stage in a glitzy Las Vegas hotel and into a room packed with cameras. Jostling for position, I asked the man with the long red tie a couple of questions and, after boasting about his status as frontrunner in the race, he told me he had a message for the UK. This will make news, I thought. Maybe something about immigration, Trump's signature campaign topic? It was not. Instead Trump wanted BBC viewers to know that he had some fine golf courses on Scotland's shores which they should visit. The answer struck me as remarkable for a man aspiring to become the so-called leader of the free world.

Of course Trump does have a genuine link to Scotland. His Gaelic-speaking mother, Mary Anne MacLeod, was born in 1912 on the island of Lewis in Scotland's Outer Hebrides and left during the Great Depression for New York where she married property developer Fred Trump. Their son's return to Scotland for four days this summer comes ahead of an official state visit in September when the president and First Lady Melania Trump will be hosted by King Charles at Windsor Castle in Berkshire. Trump is not scheduled to see the King on this visit but it is not entirely private either, as he will meet Scotland's First Minister John Swinney as well as the prime minister. Business leaders, including Scotch whisky producers, are urging Starmer and Swinney to use their meetings with Trump to lobby for a reduction in US taxes on imports, known as tariffs.

A huge security operation, which has been under way for weeks, has been scaled up in recent days. Giant transport aircraft carrying military hardware, including the president's helicopters, known when he is on board by the call sign Marine One, have been spotted at Aberdeen and Prestwick airports. Roads and lanes in Aberdeenshire and Ayrshire have been secured and closed. Airspace restrictions have been issued. Police reinforcements have been heading north across the England-Scotland border. Visits to Scotland by sitting US presidents are rare. Queen Elizabeth hosted Dwight D Eisenhower at Balmoral in Aberdeenshire in 1957; George W Bush travelled to Gleneagles in Perthshire for a G8 summit in 2005; and Joe Biden attended a climate conference in Glasgow in 2021. The only other serving president to visit this century is Trump himself in 2018 when he was met by protesters including one flying a paraglider low over Turnberry, breaching the air exclusion zone around the resort.

Even by the standards of Donald Trump the years since have been wild. When he lost the 2020 election to Joe Biden, a mob of Trump supporters responded to their leader's false claims of electoral fraud by mounting a violent assault on the US Capitol. Four years later Trump staged a stunning political comeback and since returning to the White House he has survived at least one assassination attempt while a man has been charged with another. Amid this turmoil, security surrounding Trump is supposedly tighter than ever. The US Secret Service, much criticised for failures which nearly cost the president his life, remains primarily responsible for his safety but concerns have been raised about the impact of his visit on Police Scotland's officers and budget, with one former senior officer estimating the policing cost at more than £5m. Adding to the pressure which the police are under to secure his resorts, large anti-Trump demonstrations are expected to be held in Aberdeen and Edinburgh. Police Scotland insists it has the resources it needs to deal with the visit.

While polls suggest Trump is deeply unpopular in the UK, he may actually find some sympathy in Aberdeen, a city which he and many others call"the oil capital of Europe". He has stirred the heated debate about the nature and pace of the transition from fossil fuels to renewable energy, telling BBC News last week that Aberdeen, which has prospered for decades from North Sea drilling,"should get rid of the windmills and back the oil." The environmental campaign group Uplift says Trump's claim that the North Sea can still provide the UK with a secure energy supply"runs counter to reality." Trump's pro-oil message echoes the rhetoric of Reform UK, the right-wing party led by Trump fan Nigel Farage which made progress in a recent Scottish by-election and hopes to go one step further by winning seats for the first time in next year's Scottish parliamentary election. The Scottish Parliament, known as Holyrood after its location at the foot of Edinburgh's Royal Mile, runs much of Scotland's domestic affairs, such as health, education and some taxation and benefits, while the UK parliament in London retains control of defence, foreign affairs and wider economic policy.

Trump's support for the oil industry is well known but his hatred of wind turbines appears to run even deeper. In 2012 he told me that building a wind farm off the coast of his golf course at Menie would be a"terrible error" that would"destroy Scotland." The encounter was a strange experience. At first, Trump's aides told us he was so affronted by the difficult questions he had been asked by Rona Dougall of STV News earlier that morning that he had changed his mind about speaking to the BBC. We waited anyway in the rain, for hours. Eventually the man himself emerged. After some verbal sparring he offered us burgers from a barbecue before backing down and agreeing to be interviewed. Later, asked by a committee of the Scottish Parliament in Edinburgh to provide evidence to back up his claim that Scottish tourism would be ruined by wind turbines, Trump famously replied:"I am the evidence." The wind farm was built anyway and is now clearly visible from the course.

Watch: People take shelter after gunfire breaks out between Thailand and Cambodia troops

Cambodia and Thailand have a history of occasional conflict. The two countries share a long and forested border with areas that both sides claim. There have been serious exchanges of fire in the past, too – in 2008 and 2011, clashes on a similar scale saw 40 people killed. However, these were de-escalated relatively quickly. Even as recently as this May, after an incident in which a Cambodian soldier was killed, both sides looked keen to prevent more violence, with meetings between army commanders from each country aimed at easing the tension. But on 24 July, it erupted. Thai authorities say 12 people, all civilians apart from one, were killed. Cambodia has yet to confirm whether it suffered any casualties. So why has this particular border skirmish – which kicked off after five Thai soldiers were injured in a landmine explosion on Wednesday – spread into something so much larger?

Relations between the two countries deteriorated sharply last month, when Cambodia's senior leader Hun Sen deeply embarrassed Thai Prime Minister Paetongtarn Shinawatra by leaking a phone conversation between them about the disputed border. In the conversation, Paetongtarn called him"uncle", and criticised one of her own military commanders, sparking public anger. She has since been suspended as prime minister and Thailand's Constitutional Court is considering a petition for her dismissal. It is not clear why Hun Sen chose to do this, burning a close personal relationship between their two families that goes back decades.

EPA Thai Prime Minister Paetongtarn Shinawatra was suspended in early July

Many people have faulted Paetongtarn for her conversation with Hun Sen. She appeared to believe that she could resolve their differences by appealing to his friendship with her father, former prime minister Thaksin Shinawatra. In the past that friendship was used by Thaksin's opponents to charge him with putting Cambodia's interests above those of Thailand. In 2014, when a government headed by Thaksin's sister Yingluck was deposed by a military coup, Hun Sen allowed scores of his supporters to seek sanctuary in Cambodia. The two countries have also cooperated in more shadowy areas.

In 2020, a young Thai activist who had fled to Cambodia, Wanchalerm Satsaksit, was abducted and disappeared, it is presumed by Thai operatives. And the January gunning down of a Cambodian opposition leader in broad daylight in central Bangkok was also seen by activists as an outcome of this understanding between the two countries' security services. Against this background, the leaking of Paetongtarn's conversation appears to have caught the Shinawatra family completely off-guard. The responses from both Thaksin and Paetongtarn reveal a sense of betrayal. This has led to an increasingly bitter war of words between the two countries. But it is more than just words. Thai police have also begun investigating powerful Cambodian business figures alleged to be linked to underworld gambling and scam centres, while trade worth billions of dollars a year has stopped. At the border itself, there is a heightened risk of more serious clashes between the two armies. But rather than back off, Cambodia's Hun Sen seems to have jumped at the opportunity to ramp up rhetoric against Thailand and the Shinawatra family in particular.

Described by his lawyer as"the man who has spent the longest time in prison for events linked to the Israeli-Palestinian conflict," Abdallah is expected to be put on a flight directly to Beirut.

"Make sure the reindeer have plenty of water - and don't forget to drink a glass every hour too," Santa reminds a team of elves busy making presents for next Christmas as Lapland swelters in a record heatwave.

It's not every day that Father Christmas finds himself briefing his elves about the hazards of sunstroke, but this summer northern Finland has seen temperatures hover around 30C for days on end.

As for Santa, he will be staying indoors most of the day - his bright red costume trimmed with fur is very warm."I'm only going out for a swim in the lake in the forest after 18:00, when the weather has started to cool off," he says.

    ---

While Santa's workshop in the city of Rovaniemi is adapting with cheerful resilience, the unusually warm temperatures in the Arctic are a serious matter – and scientists are pointing at climate change as the culprit.

After an unusually cold and rainy spring and early summer, the whole of Finland – including the far north of Lapland, 500km (310 miles) above the Arctic Circle – suddenly became caught up in a continuous spell of hot weather. By 25 July, the heatwave in Rovaniemi will have lasted 15 days.

    ---

In Finland a heatwave is defined as a period of at least three consecutive days where the daily

"The last time Finnish Lapland had a similarly long heatwave was in 1972," Savela says. But even that only lasted 12 to 14 days, depending on the exact location."That record has now been broken."

It's not just Rovaniemi that's been gripped by scorching temperatures. Several other weather stations across Lapland have registered their longest ever heatwaves since records began. The highest temperature of the heatwave, 31.7C, was measured at two locations, Ylitornio and Sodankylä, earlier this week. That's about 10C above the seasonal average for Lapland.

**BBC/Erika Benke The thermometer at the Santa Claus village in Lapland this week read 33C in the sun**

The heatwave has prompted renewed concern about the accelerating pace of climate change in the Arctic, which is warming four to five times faster than the rest of the Earth.

Savela notes that this particular, long heatwave was not directly caused by climate change. However, he says,"Climate change has had an impact: without it, temperatures over the last two weeks would have been lower".

Prof Jeff Weller, University of the Arctic Research Chair at the University of Oulu, agrees. What is climate change? A really simple guide Heatwaves and extreme weather events in summer and winter alike have become so frequent that they can only have been caused by fundamental changes to the climate system.

"All over the world, every day, climate change is manifested in extreme heat and extreme precipitation events," says Prof Weller."The fingerprint of climate change is upon us."

Heatwaves are becoming more common due to human-caused climate change, according to the UN's Intergovernmental Panel on Climate Change. Extreme hot weather will happen more often – and become even more intense – as the planet continues to warm, it has said.

    ---

The extreme heat is also affecting Lapland's famed reindeer. Celebrated worldwide as Santa's sleigh-pullers at Christmas, reindeer here roam freely across forests and fells. But as they're hounded by mosquitoes – which thrive in hot weather – reindeer are now fleeing to roads and villages in search of relief.

"For reindeer the only option would be to go to higher, windier elevations but in Finnish Lapland the highest elevation is only about 1,000m (3,300 ft)," says Prof Weller.

He adds that because more extreme and longer heatwaves will occur more frequently in the Arctic in the future,"reindeer herders might end up having to build big barns to provide shade for their animals".

    ---

It's not just Santa and his reindeer who are struggling. Lapland is traditionally known as a cool tourist destination – but this year, visitors are puzzled.

"It's super-hot here – 30C is killing me. I came to escape the heat," says Silvia, a tourist from Prague visiting Santa's holiday village in Rovaniemi."I expected much colder weather and packed the wrong clothes. I only have one short-sleeve t-shirt with me – I've been wearing it every day."

An Ibiza hotel and music venue has cancelled its upcoming events after two British men died on its premises in separate incidents.

A 19-year-old man, named as Gary Kelly, died in a fall at Ibiza Rocks on Monday while another man, 26-year-old Evan Thomson, died earlier this month.

The venue said it was"deeply shocked and devastated" by the incidents and had decided to pause its scheduled events programme due to"the seriousness of the situation and out of respect for those involved".

**"We're grateful he's at least going to prison", says attorney to Breonna Taylor's family**

A former Kentucky police officer has been sentenced to 33 months in prison after being convicted in connection with a raid that resulted in the fatal shooting of Breonna Taylor, a black woman, in her home.

A federal jury last year found Brett Hankison guilty of violating Taylor's civil rights by using excessive force. The maximum sentence for the charge was life in prison.

The sentencing comes days after the Trump administration asked the judge to give Hankison a one-day sentence - a position that starkly contrasts with the approach to the case under President Joe Biden.

Hankison is the only officer who has been charged and convicted directly in connection with the botched raid.

Another former officer, Kelly Goodlett, who pleaded guilty to conspiring with a colleague to falsify the affidavit used to obtain a search warrant for Taylor's home and to cover up their actions after her death, will be sentenced next year.

After his sentence, Hankison will face three years of supervised release. Tamika Palmer, Taylor's mother, and lawyers for the family spoke after the sentencing on Monday.

Authorities believed Taylor's former boyfriend was using her home to hide narcotics. Mr Walker fired a single shot when the police knocked the door down, hitting one officer, Sgt John Mattingly, in the leg.

Mr Walker said the officers did not announce themselves as police, and he thought they were intruders. The three officers returned fire, shooting 32 bullets into the flat.

Hankinson fired 10 times into her apartment, in order, he said during the trial, to protect fellow officers. None of Hankison's bullets hit anyone, but they did enter a neighbouring property, where a pregnant woman, a five-year-old and a man had been sleeping.

Prosecutors said Hankison acted recklessly and"violated one of the most fundamental rules of deadly force: If they cannot see the person they're shooting at, they cannot pull the trigger."

Outside the courthouse, protesters waiting for the verdict blocked the streets chanting Taylor's name. Several people, including Taylor's aunt, Bianca Austin, were detained by police.

In early November 2024, Hankison was convicted on one count of civil rights abuse.

"His use of deadly force was unlawful and put Ms Taylor in harm's way," then Attorney General Merrick Garland, a Biden-appointee, said in a statement.

"This verdict is an important step toward accountability for the violation of Breonna Taylor's civil rights, but justice for the loss of Ms Taylor is a task that exceeds human capacity."

Days after Hankinson's conviction, Donald Trump won re-election - a political shift that meant the sentencing recommendation would come not from the Biden administration, which brought the charges, but from the Trump-led justice department.

Last week, that recommendation - a request for Hankison to serve one day in prison - stunned some, including Taylor's family.

"Every American who believes in equal justice under the law should be outraged," attorneys for the family said.

"Recommending just one day in prison sends the unmistakable message that white officers can violate the civil rights of Black Americans with near-total impunity."

In its sentencing request, the justice department argued that although Hankison was involved in"executing the warrant" during the deadly raid, he did not shoot Taylor"and is not otherwise responsible for her death".

The justice department also said that additional prison time"would simply be unjust under these circumstances".

Ordinarily, sentencing recommendations are signed by lawyers involved in the case or career justice department employees who deal with sentencing requests.

In this case, Trump's appointee to run the Civil Rights Department, Harmeet Dhillon, signed the recommendation.

It was a warm, late May afternoon in 2024 in lower Manhattan. The jury in Donald Trump's trial over hush money paid by his former lawyer to adult film star Stormy Daniels was out deliberating for a second day. Assuming we were in for a long wait, I took myself off to lunch with the BBC team at the world-famous Katz's deli for a Reuben sandwich. Then all hell broke loose. The jury was returning. According to one rumour, they were just being sent home for the day; another suggested there was a verdict. Seconds before the BBC News at Ten went on air, I arrived breathless at the live television point outside the courthouse, smashing my phone screen on the pavement in my hurry. One by one, the verdicts filtered through: guilty... guilty... guilty... it went on.

All 34 charges came back guilty, and I spent that night's main news bulletin explaining the enormity of the idea that a former president was now a convicted felon – a first in US history. As the BBC's senior North America correspondent, I'd spent months covering the multitude of Trump's legal problems in courts up and down the East Coast. Four separate criminal cases; several civil actions; it was coming at him from all sides, threatening not just his liberty but his whole political and commercial existence. Spool on a year, and the boot is thoroughly on the other foot. Three major Supreme Court judgments – one giving presidents and former presidents broad immunity from prosecution; a second dismissing the ruling that Trump's attempts to overturn the 2020 election results disqualified him from running for office again; and a third, just last month, curbing district judges' abilities to stall the president's agenda – have all emboldened this president who, having reshaped the Supreme Court with a solid conservative majority, now has the lower courts in his sights.

Those federal district judges – who had often made rulings on immigration policy that they said applied nationwide – are now facing a full-frontal onslaught from an administration that has questioned their legitimacy, and some say flouted their very authority. The question is, should they fight back to reassert their authority – and if so, how can they? And will this all permanently reshape the balance of powers in the US, even after Donald Trump's term ends?

Several judges – both active and retired – have told me that the scale of the"attack" is like nothing seen before. John E Jones III, a former judge in Pennsylvania, appointed by a Republican president, and now president of Dickinson College, said:"I think it's fair to say that in particular, the US district courts… [are] under attack by the administration in a way that is unprecedented." As well as his colourful remarks to me on the phone during our recent interview, the US President has variously called judges"crooked","monsters","deranged","lunatics","USA hating", and"radical left".

He has also called for the impeachment of those he disagrees with. And there have been threats to sue judges too. His deputy chief of staff for policy, Stephen Miller, has been even more forthright, declaring that the country is living under a judicial tyranny."Each day, they change the foreign policy, economic, staffing, and national security policies of the administration," he posted on the social media site X in March."It is madness. It is lunacy. It is pure lawlessness."It is the gravest assault on democracy. It must and will end."

    **From death threats to doxxing**

Judges have faced growing hostility, and in some cases threats of violence from the public."[They] are facing threats that they never have faced before," says Nancy Gertner, a former federal judge who now teaches at Harvard Law School. She was appointed by President Bill Clinton and spent 17 years on the federal bench in Massachusetts."There's no question that the kind of opprobrium that the administration heaps on judges with whom they disagree is unlike any other time." Judge Gertner says she knows of serving judges who have received death threats this year that are understood to have been prompted by their blocking or delaying some of the president's executive orders. There is no suggestion that Trump had any knowledge of the threats.

Figures compiled by the US Marshals Service, which is tasked with protecting the judiciary, show that, to mid-June, there were more than 400 threats against almost 300 judges – surpassing the totals for the entire year of 2022. Some of the threats involve doxxing – the publication of personal information about the person or their family, which risks opening them up to attack. Other forms of intimidation this year have been more sinister still. According to Esther Salas, a serving district judge in New Jersey, more than 100 judges have been subjected to fake pizza delivery orders. No big deal, you might think, but the deliveries are often accompanied with threats and in around 20 cases, the orders were placed by people who used the name Daniel Anderl, Judge Salas's late son. He was killed five years ago by a disgruntled lawyer from a case heard by his mother. The assailant, who also shot her husband, had posed as a pizza delivery man.

**Getty Images Esther Salas's home following the attack in July 2020 that killed her son**

Judge Salas told me of her reaction to hearing what was going on:"To say that I was angry is an understatement. And then of course, to have come home and tell my husband who nearly [died]." The rise in threats began before the current administration but Judge Salas says we are in new territory now."We are inviting individuals to do us harm when inflammatory rhetoric [is used]," she claims."That is giving a green light to anyone who thinks they may need to take things into their own hands. And our leaders know that." Many supporters of the current administration including Jeff Anderson, one of the architects of the Project 2025 program (which many saw as a blueprint for Trump's second term), reject the idea that presidential rhetoric is to blame for raising the temperature.

Mr Anderson argues that the left is more to blame for hostility towards judges:"The most high-profile threat to anyone on the federal courts was when someone tried to assassinate [the conservative] Supreme Court Justice Brett Kavanaugh."There's this tendency to try to characterise the Trump administration as being what has facilitated this. I think a lot of the more radical revolutionary notions that we need to take law in our own hands and the ends justify the means… tend to [be] from the left in America."

    **A blizzard of executive orders**

While other presidents have clashed with the courts, Trump's confrontations are unquestionably unique in their scale and fury, and they were perhaps inevitable, given that he arrived in the White House with a blizzard of executive orders aimed at getting what he wanted quickly. On day one alone, 26 were signed. There have been another 140 to the beginning of July – more than President Joe Biden signed during his four-year term, and only around 100 fewer than President Barack Obama in his eight years in the White House.

Trump could have asked Congress to enact laws to implement these policies; after all, Republicans currently control both chambers. But that process takes time, and Congress has been preoccupied with the president's flagship domestic legislation – the so-called"Big Beautiful Bill" – meaning that there has been no time or political capital for other priorities. Of course, executive orders are perfectly within the president's prerogative. The power to make executive orders comes directly from Article II of the US Constitution, so Trump is not defying or bypassing the constitution – he's pulling the levers of government in a way he's allowed to do, provided the orders cite legislative authority; and those orders do have the force of law. What the president can't do, with the sweep of his pen, is make new laws, or do things that go contrary to the Constitution. And if Congress doesn't step in, then the only option for those who want to challenge the orders is to go to court.

**Getty Images While other presidents have clashed with the courts, Trump's confrontations are unquestionably unique in their scale**

The sweeping nature of the orders he has signed, many touching on constitutional issues such as the right of everyone born in the US to citizenship, has led to dozens of nationwide injunctions pending the outcome on the merits of the individual cases. That is why Trump's Supreme Court victory at the end of June, curbing such nationwide injunctions, is so significant."These district court judges have been totally out of line and out of control," argues Jeff Anderson.

    **Are judges blocking 'electorate desires'?**

The administration has deployed various arguments. The judiciary has been accused of"overreach" and judges themselves accused of being"activists". But perhaps the most fundamental – and most philosophical – criticism is that they are standing in the way of the will of the people. As Stephen Miller has put it,"out of control Marxist judges" are standing in the way of the"desires of the electorate". It's an argument that, according to many judges, misunderstands the constitution in a fundamental way."We're a nation of laws, not men," explains judge John E Jones III."A mandate to the president of the United States does not mean a mandate to disregard the law. That's evident, but this is papering over a fundamental disregard of the law and the constitution."

    ---

**Getty Images Executive orders are perfectly within the president's prerogative under Article II of the US Constitution**

There are signs that some individuals in the administration, despite its assertions to the contrary, could well be toying with flouting the authority of the courts. The president's border tsar, Tom Homan, went on television over a court's attempts to prevent the deportation of several hundred Venezuelans and said:"I'm proud to be a part of this administration. We're not stopping. … I don't care what the judges think." But, in his interview with me last week, the President denied he was defying the judiciary, pointing out that when rulings have gone against him, he has sought remedy through the court process."I have too much respect for it to defy it. I have great respect for the judiciary. And you can see that," he told me, adding:"That's why I'm winning on appeal."

    ---

**'The US faces a catastrophic situation'**

Some vocal critics of the president go further and claim he's tearing up the whole system of checks and balances in which the three equal branches of government (the presidency, congress and the judiciary) each act as a brake on the others."This is a huge turning point for the country," says Professor Laurence Tribe, one of the nation's foremost constitutional experts, who has become a forthright critic of the president. He argues that Congress has ceased to perform its oversight function and fears"the United States is facing a catastrophic situation"."The idea of three branches… was hatched at our founding - before the rise of political parties and before the rise of demagogues as effective and charismatic as Trump," he told me."The whole system is completely out of balance."

    ---

    **EPA**
    EPA

That balance that Professor Tribe talks about has long been debated and the shift in power towards the presidency is not a new complaint. After the Watergate scandal in the 1970s, which saw President Richard Nixon flout many of the norms followed by previous presidents, a whole slew of legislation was passed to curb the executive and make it more accountable. But some of the changes involved merely adopting new norms such as publication of presidential tax returns and avoiding financial conflicts of interest – and this president has showed little concern to be seen to follow those norms.

    ---

    **The judiciary is fighting back**

When it comes to the relationship between the presidency and the courts, though, even Nixon stopped short of defying their authority, eventually handing over the infamous Watergate tapes, after months of refusing to do so, once the Supreme Court unanimously ordered it. Trump has come close to defiance. In one instance, after being ordered to facilitate the return of a man wrongly deported to El Salvador, Kilmar Ábrego García, the administration was accused of slow-walking the process of complying with the Supreme Court's decision. Even Trump's Attorney General, Pam Bondi, said:"He's not coming back to our country." It took two months for the administration to follow the court's order. That was seen by the president's critics as a taste of what could follow. After all, there are only two ways a president can be truly held to account – one is by removal at an election; the second is by impeachment in Congress, and Trump has already survived two of those.

But if there truly is a plan to defy or neuter the courts, the judiciary is not giving in without a fight. Even after the Supreme Court ruled to curb those nationwide injunctions at the end of June (incidentally, presidents of both parties have complained about such injunctions in the past), another judge slapped one on Trump's asylum policy. Earlier this month, a US district judge issued a fresh nationwide block on Trump's executive order restricting the automatic right to citizenship for babies born to undocumented migrants or foreign visitors, drawing more furious words from the White House. This battle is enjoined, but it's far from over – and its consequences for this president and future presidents are unpredictable. Top image credits: Bloomberg via Getty and EPA-EFE/REX/Shutterstock
